1. Introduction
Welcome to Softclue Academy, operated by East Midlands Combined County Authority, a limited company registered in the United Kingdom ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of our website, courses, services, and learning materials (collectively, the "Platform"). By registering for an account, enrolling in a course, or otherwise using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.
2. Eligibility
You must be at least 16 years old to use the Platform. By using the Platform, you represent that you meet this age requirement and that all information you provide is accurate and complete.
3. Accounts and Registration
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised use. We reserve the right to suspend or terminate accounts that violate these Terms.
4. Course Access and Content
We grant you a limited, non-exclusive, non-transferable licence to access the courses you enrol in for your personal, non-commercial use. You may not reproduce, distribute, modify, or create derivative works from our content without prior written consent. Course materials remain the intellectual property of Softclue Academy or our licensors.
5. Acceptable Use
You agree not to use the Platform for any unlawful purpose or in any way that could damage, disable, overburden, or impair our servers or networks. Prohibited conduct includes: harassment of other learners, sharing login credentials, uploading malware, cheating on assessments, and reverse engineering our software.
6. Payments and Refunds
Certain features, courses, and certificates require payment. All fees are quoted in GBP unless otherwise stated. Payments are processed securely by Stripe Payments Europe, Ltd. ("Stripe"), our payment processor. Softclue Technologies LTD is the merchant of record and is responsible for billing, invoicing, taxes, and customer support. Refunds are handled in accordance with our Refund Policy; you can request a refund by emailing support@academy.softclue.uk within 30 days of purchase.
7. Certificates
Certificates of completion or achievement are awarded based on meeting the stated course requirements. Certificates remain our property and may be revoked if earned through fraudulent means. They are for personal use and do not confer any professional accreditation unless explicitly stated.
8. Termination
We may suspend or terminate your access to the Platform at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, your right to use the Platform ceases immediately.
9. Limitation of Liability
To the fullest extent permitted by law, Softclue Academy shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Platform. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
10. Changes to Terms
We may update these Terms from time to time. Material changes will be notified via email or a notice on the Platform. Continued use after changes constitutes acceptance of the revised Terms.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
